By accessing or using Tipity Online ("Platform"), operated by Tipity Labs ("Company"), you agree to be bound by these Terms of Service. You must be at least 18 years of age to use this Platform.
Tipity Online is an AI-powered creative marketplace with integrated print-on-demand fulfillment. The Platform enables users to: generate AI artwork, upload original artwork, create shareable merchandise links, list digital assets for sale, and earn royalties on sales. The Platform acts as an intermediary connecting creators with print-on-demand fulfillment providers and customers.
You retain ownership of original content you create and upload. By listing content on the Platform, you grant Tipity Labs a non-exclusive, worldwide, royalty-free license to display, reproduce, distribute, and promote your content solely in connection with operating and marketing the Platform. You represent and warrant that you own or have all necessary rights to the content you upload and that it does not infringe any third-party rights.
All payments are processed through third-party payment processors (Stripe). We do not store credit card information. Creator royalties accumulate in an internal balance and may be withdrawn when the minimum threshold is met. Tipity Labs reserves the right to withhold payouts pending fraud investigation and to reclaim royalties on refunded or charged-back orders.
Physical products are manufactured and fulfilled by third-party partners including Printful, Printify, Gooten, and Prodigi. Tipity Labs acts solely as an intermediary platform — we do not manufacture, store, inspect, or ship products directly. Production times, shipping estimates, and product quality are subject to the fulfillment partner's standards.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIPITY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Any dispute arising out of these Terms shall be resolved through binding individual arbitration administered by the American Arbitration Association in the Commonwealth of Pennsylvania. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any activity harmful to the Platform or its users.
